১.১ obak.com.bd-এ স্বাগতম।অবাক নেক্সটজেন আইটি (“অবাক”) আপনাকে এই পৃষ্টায় সংযুক্ত টার্মস ও কন্ডিসন (“শর্তাবলী”) সাপক্ষে obak.com.bd ওয়েবসাইটে বা মোবাইল অ্যাপ্লিকেশন/অ্যাপ বা অন্য কোনো মিডিয়া (“ওয়েবসাইট”)প্রবেশাধিকার প্রদান করে ।আপনি টার্মস দ্বারা এখানে সংযুক্ত যোগ্যতার মানদন্ডের ভিত্তিতে একজন নিবন্ধিত বা অতিথি ব্যবহারকারী(“ব্যবহারকারী”) হিসেবে আবদ্ধ হতে সম্মত ।ওয়েবসাইট টি আপনার নিয়মিত ব্যবহারের জন্য দয়া করে টার্মস ও কন্ডিসন গুলো মনোযোগ সহকারে পড়ুন । আপনি এই শর্তাবলী দ্বারা আবদ্ধ হতে আপনার চুক্তি স্বাক্ষরকারী।আপনি যদি শর্তাবলী দ্বারা আবদ্ধ হতে না চান,তবে ওয়েবসাইট টি বা আমাদের পরিষেবাগুলি ব্যবহার করতে আপনি অবশ্যই সাবস্ক্রাইব করবেন না ।

1.1 Welcome to obak.com.bd. Obak Nextgen IT (“Obak”) provides access to the obak.com.bd website or the mobile application/app or any other media (“Website”) to you subject to the terms and conditions (“Terms”) set out on this page. By using the Website, you, a registered or guest user in terms of the eligibility criteria set out herein (“User”) agree to be bound by the Terms. Please read them carefully as your continued usage of the Website, you signify your agreement to be bound by these Terms. If you do not want to be bound by the Terms, you must not subscribe to or use the Website or our services.

১.২ উহ্যভাবে বা স্পষ্টভাবে এই শর্তাদি গ্রহণ করার মাধ্যমে, আপনি সময় সময় সংশোধিত অবাক নীতি (https://obak.com.bd/privacy-policy-এ উপলব্ধ গোপনীয়তা নীতি সহ কিন্তু সীমাবদ্ধ নয়) দ্বারা আবদ্ধ হতে সম্মত হন এবং মেনে নেন ।

1.2 By impliedly or expressly accepting these Terms, you also accept and agree to be bound by Obak Policies (including but not limited to Privacy Policy available at https://obak.com.bd/privacy-policy/) as amended from time to time.

১.৩ এই শর্তাবলীতে, “আপনি”, “ব্যবহারকারী” এর রেফারেন্সের অর্থ হবে ওয়েবসাইট অ্যাক্সেস করা শেষ ব্যবহারকারী/গ্রাহক,যিনি এই ওয়েবসাইটের মাধ্যমে দেওয়া বিষয়বস্তু এবং পরিষেবাগুলি ব্যবহার করেন ।”ওয়েবসাইট”, “Obak”, “obak.com.bd”, “আমরা”, “আমাদের” এবং “আমাদের” এর রেফারেন্সের অর্থ হবে ওয়েবসাইট এবং/অথবা Obak Nextgen IT।

1.3 In these Terms, references to “you”, “User” shall mean the end user/customer accessing the Website, its contents and using the Services offered through the Website. References to the “Website”, “Obak”, “obak.com.bd”, “we”, “us” and “our” shall mean the Website and/or Obak Nextgen IT.

১.৪ এখানে উল্লিখিত বিষয়বস্তুগুলো তথ্য ও যোগাযোগ প্রযুক্তি আইন, ২০০৬ (তথ্য ও যোগাযোগ প্রযুক্তি আইন, ২০০৬) এর শর্তাবলী এবং সময়ে সময়ে সংশোধিত এবং প্রযোজ্য আইনের অধীনে একটি ইলেকট্রনিক রেকর্ড গঠন করে। যেমন, এই নথিতে কোনও শারীরিক বা ডিজিটাল স্বাক্ষরের প্রয়োজন নেই এবং ওয়েবসাইট এবং ব্যবহারকারীর মধ্যে একটি বৈধ এবং বাধ্যতামূলক চুক্তি তৈরি করে ।

1.4 The contents set out herein form an electronic record in terms of তথ্য ও যোগাযোগ প্রযুক্তি আইন, ২০০৬ (Information & Communication Technology Act, 2006) and rules there under as applicable and as amended from time to time. As such, this document does not require any physical or digital signatures and forms a valid and binding agreement between the Website and the User.

1.5 The Website is operated by Obak Nextgen IT, It’s ecommerce business run under the laws of Bangladesh having its registered office at Kushgaon,Haripur,Thakurgaon 5130, Bangladesh. All references to the Website in these Terms shall deem to refer to the aforesaid entity in inclusion of the online portal.

Your use of the linked sites will be subject to the terms of use and service contained within each such site.

১.৭ আমরা যেকোনো সময় এই শর্তাবলী পরিবর্তন করার অধিকার সংরক্ষণ করি। ওয়েবসাইটে পোস্ট করা হলে এই ধরনের পরিবর্তন কার্যকর হবে। আমরা এই ধরনের কোনো পরিবর্তন পোস্ট করার পরে ওয়েবসাইট ব্যবহার চালিয়ে যাওয়ার মাধ্যমে, আপনি পরিবর্তিত হিসাবে শর্তাদি স্বীকার করেন।

1.7 We reserve the right to change these Terms at any time. Such changes will be effective when posted on the Website. By continuing to use the Website after we post any such changes, you accept the Terms as modified.

১.৮ এই শর্তাবলী নিচে সেট করা শর্তাবলী অনুসারে আপনি বা Obak দ্বারা সমাপ্ত না হওয়া পর্যন্ত প্রযোজ্য হবে:

1.8 These Terms will continue to apply until terminated by either You or Obak in accordance with the terms set out below:

১.৯ অবাক এর সাথে চুক্তিটি শেষ হতে পারে (ক) ওয়েবসাইট অ্যাক্সেস না করা;বা (খ) আপনার অ্যাকাউন্ট বন্ধ করা,যদি এই ধরনের বিকল্প আপনার জন্য উপলব্ধ করা হয়.

1.9 The agreement with Obak can be terminated by (i) not accessing the Website; or (ii) closing Your Account, if such option has been made available to You.

১.১০ পূর্বোক্ত সত্ত্বেও, এই শর্তাবলীতে সেট করা এই বিধানগুলি যা তাদের প্রকৃতির দ্বারা টিকে থাকে, এই চুক্তির সমাপ্তি / মেয়াদ শেষ হওয়ার পরেও বেঁচে থাকবে।

1.10 Notwithstanding the foregoing, these provisions set out in these Terms which by their very nature survive are meant to survive termination, shall survive the termination / expiry of this agreement.

২.১ এই ওয়েবসাইটটির ব্যবহার শুধুমাত্র সেই ব্যক্তিদের জন্য উপলব্ধ যারা চুক্তি আইন, ১৮৭২ এর অধীনে আইনিভাবে চুক্তি করতে পারেন।

2.1 Use of the Website is available only to such persons who can legally contract under the Contract Act, 1872.

২.২ যদি আপনি একজন অপ্রাপ্তবয়স্ক হন অর্থাৎ ১৮ বছরের কম বয়সী হন, তাহলে আপনি obak.com.bd-এর ব্যবহারকারী হিসেবে নিবন্ধন করবেন না এবং ওয়েবসাইটটিতে লেনদেন বা ব্যবহার করবেন না। নাবালক হিসেবে আপনি ওয়েবসাইট এর ব্যবহার বা লেনদেন করতে চাইলে, এই ধরনের ব্যবহার বা লেনদেন ওয়েবসাইটে আপনার আইনি অভিভাবক বা পিতামাতার দ্বারা করা হতে পারে। অবাক আপনার সদস্যপদ বাতিল করার অধিকার সংরক্ষণ করে এবং/অথবা আপনাকে ওয়েবসাইটটিতে অ্যাক্সেস প্রদান করতে অস্বীকার করে যদি এটি অবাক এর নোটিশে আনা হয় বা যদি এটি আবিষ্কৃত হয় যে আপনি ১৮ বছরের কম বয়সী।

2.2 If you are a minor i.e. under the age of 18 years, you shall not register as a user of obak.com.bd and shall not transact on or use the Website. As a minor if you wish to use or transact on this website, such use or transaction may be made by your legal guardian or parents on the Website. Obak reserves the right to terminate your membership and / or refuse to provide you with access to the website if it is brought to Obak’s notice or if it is discovered that you are under the age of 18 years.

২.৩ শর্তাদি স্বীকার করে বা ওয়েবসাইটে ব্যবহার বা লেনদেন করার মাধ্যমে, ব্যবহারকারী অপরিবর্তনীয়ভাবে ঘোষণা করেন এবং অঙ্গীকার করেন যে তিনি আইনি বয়সের অর্থাৎ আঠারো (১৮) বছর বা তার বেশি বয়সী এবং একটি বাধ্যতামূলক চুক্তিতে প্রবেশ করতে সক্ষম এবং এই ধরনের ব্যবহার একটি চুক্তি গঠন বলে গণ্য হবে এই ওয়েবসাইট এবং এই ধরনের ব্যবহারকারীর মধ্যে প্রযোজ্য আইনের অধীনে অনুমোদিত পরিমাণে।

2.3 By accepting the Terms or using or transacting on the Website, the User irrevocably declares and undertakes that he/she is of legal age i.e. 18 years or older and capable of entering into a binding contract and such usage shall be deemed to form a contract between the Website and such User to the extent permissible under applicable laws.

3.1 When you use obak.com.bd, or contact us via phone or email, you consent to receive communication from us. You authorize us to communicate with you by e-mail, SMS, phone call or by posting notices on the website or by any other mode of communication. For contractual purposes, you consent to receive communications (including transactional, promotional and/or commercial messages), from us with respect to your use of the website and/or your order placed on the Website. Additionally any disclosures posted on the site, or sent to you by email/SMS fulfill the legal obligation of communication made in writing.

৪.১ যেকোন ব্যক্তি ওয়েবসাইটে নিবন্ধন করে বা অতিথি হিসাবে ওয়েবসাইট ব্যবহার করে ওয়েবসাইট অ্যাক্সেস করতে পারেন। যাইহোক, কোনও অতিথি ব্যবহারকারীর কিছু নির্দিষ্ট সুবিধা/প্রচারমূলক অফার সহ ওয়েবসাইটের সমস্ত বিভাগে অ্যাক্সেস নাও থাকতে পারে, যা শুধুমাত্র নিবন্ধিত ব্যবহারকারীদের উদ্দেশ্যে সংরক্ষিত থাকবে এবং যা ওয়েবসাইটের নিজস্ব বিবেচনার ভিত্তিতে সময়ে সময়ে পরিবর্তিত হতে পারে।

4.1 Any person may access the Website either by registering to the Website or using the Website as a guest. However, a guest user may not have access to all sections of the Website including certain benefits/promotional offers, which shall be reserved only for the purpose of registered Users, and which may change from time to time at the sole discretion of the Website.

4.2 If you wish to register your account with the Website, you shall be required to create an account by registering with a valid Bangladeshi mobile number and/or with your Facebook account or your email address or by filling in the details prescribed in the Website registration form. You will then receive a password or One-Time-Password (OTP) with which you can login to the website to place orders.

4.3 If you use the website, you will be responsible for maintaining the confidentiality of your username and password and you will be responsible for all activities that occur under your username and you will be under the obligation to restrict access to your computer or mobile phone to prevent unauthorized access to your account. 4.4 The Website may be inaccessible for such purposes as it may, at its sole discretion, deem necessary, including but not limited to regular maintenance. However, under no circumstances will Obak be held liable for any losses or claims arising out of such inaccessibility to the Users and the Users expressly waive any claims against Obak in this regard.

৪.৫ অবাক একটি প্ল্যাটফর্ম হিসাবে বিভিন্ন মোবাইল নম্বর সহ একক ব্যবহারকারীর মালিকানাধীন একাধিক অ্যাকাউন্ট সমর্থন বা উৎসাহিত করে না এবং পরিষেবার যে কোনও ধরণের অপব্যবহারের আওতায় পড়তে পারে এমন কোনও অ্যাকাউন্টকে সীমাবদ্ধ, নিষ্ক্রিয় বা নিষ্ক্রিয় করার অধিকার সংরক্ষণ করে ৷

4.5 Obak as a platform does not support or encourage multiple accounts owned by a single user even with different mobile numbers & reserves the right to restrict , deactivate or disable any account that might fall under any sort of abuse to the service.

5. Charges

৫.১ ওয়েবসাইটের সদস্যপদ ব্যবহারকারীদের জন্য বিনামূল্যে। অবাক ওয়েবসাইট ব্রাউজ করার জন্য কোনো ফি নেয় না। অবাক সময়ে সময়ে তার ফি নীতি পরিবর্তন করার অধিকার সংরক্ষণ করে। বিশেষ করে, অবাক তার নিজস্ব বিবেচনার ভিত্তিতে নতুন পরিষেবাগুলি প্রবর্তন করতে পারে এবং ওয়েবসাইটে দেওয়া কিছু বা সমস্ত বিদ্যমান পরিষেবাগুলিকে সংশোধন করতে পারে ৷ এই ধরনের ঘটনায় যেমনটি হতে পারে, অবাক প্রদত্ত নতুন পরিষেবাগুলির জন্য ফি প্রবর্তন করার বা বিদ্যমান পরিষেবাগুলির জন্য ফি সংশোধন/পরিবর্তনের অধিকার সংরক্ষণ করে ৷ ফি নীতিতে পরিবর্তনগুলি ওয়েবসাইটে পোস্ট করা হবে এবং এই ধরনের পরিবর্তনগুলি ওয়েবসাইটে পোস্ট করার সাথে সাথেই স্বয়ংক্রিয়ভাবে কার্যকর হবে ৷

5.1 Membership on the website is free for users. Obak does not charge any fee for browsing the website. Obak reserves the right to change its fee policy from time to time. In particular, Obak may at its sole discretion introduce new services and modify some or all of the existing services offered on the website. In such an event, Obak reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the fee policy will be posted on the website and such changes will automatically become effective immediately after they are posted on the website.

5.2 Products delivery charge in every single order 40 taka for maximum weights of 25 kg.

৬.১ obak.com.bd-এ থাকা উপাদান (বিষয়বস্তু, এবং অন্য কোনো বিষয়বস্তু, সফ্টওয়্যার বা পরিষেবা সহ) হল Obak Nextgen IT, এর সহযোগী সংস্থা, সহযোগী এবং/অথবা তৃতীয় পক্ষের লাইসেন্সকারীদের সম্পত্তি। অবাক নেক্সটজেন আইটি থেকে লিখিত অনুমতি ছাড়া এই ওয়েবসাইটের কোনও উপাদান কপি, পুনরুত্পাদন, পুনঃপ্রকাশ, ইনস্টল, পোস্ট, প্রেরণ, সংরক্ষণ বা বিতরণ করা যাবে না।

6.1 The material (including the content, and any other content, software or services) contained on obak.com.bd are the property of Obak Nextgen IT, its subsidiaries, affiliates and/or third party licensors. No material on this website may be copied, reproduced, republished, installed, posted, transmitted, stored or distributed without written permission from Obak Nextgen IT.

8.2 Any short term or long term promotional acitivity or offer(s) are by default valid for a single order within the offered time frame under any specific account on obak.com.bd. Any repetitive or suspicious or abusive practice during any offer or promotion might result as cancelled order & obak reserves the right to do so to protect the rigths & beniits of other users. Account that tends to abuse any offer by any means on the platform can also get termniated to maintain hygiene factor on the platform. The automated abuse detecction technology that obak has can be also enforced at anytime without any sort of prior notice.

8.3 Discount code(s) offered to any/all segment of customer(s) through different marketing channels might get disabled or extended by the authority at anytime without any prior notice. The modality can also be changed to accomodate with price changes or fluctuation & intense of uses of the same by the user base to protect any sort of abuse or suspective uses.

9.1 Your order is an offer to us to buy the product(s) in your order. When you place an order to purchase a product from us, you will receive an e-mail and/or SMS to your mobile phone number confirming receipt of your order and/or containing the details of your order (the “Order Confirmation E-mail and/or SMS”). The Order Confirmation E-mail and/or SMS is acknowledgement that we have received your order, but does not confirm acceptance of your offer to buy the product(s) ordered; that when we send the Order Confirmation E-mail and/or SMS a contract called an “agreement to sell” is concluded in accordance with Section 4(3) of the Sale of Goods Act, 1930 i.e. the transfer of the property in the goods is to take place at a future time when the product(s) is/are delivered to your designated address. We only accept your offer, and the above “agreement to sell” becomes a contract of sale for product(s) ordered by you in accordance with Section 4(4) of the Sale of Goods Act, 1930, when the product(s) is/are delivered to your designated address and at that time the property in the goods is transferred from us to you.

You can purchase a maximum of fifteen thousand (15000) taka worth of products in a single order. Please note that we sell products only in quantities which correspond to the typical needs of an average household. This applies both to the number of products ordered within a single order and the placing of several orders for the same product where the individual orders comprise a quantity typical for a normal household.

১০.১ অবাক যতটা সম্ভব নির্ভুল হওয়ার চেষ্টা করে। অবাক নিজেদের দ্বারা কোন পণ্য তৈরি বা উত্পাদন করে না। অতএব, Obak কোনো পণ্যের বিবরণ বা অন্যান্য বিষয়বস্তু সঠিক, সম্পূর্ণ, নির্ভরযোগ্য, বর্তমান বা ত্রুটি-মুক্ত হওয়ার নিশ্চয়তা দেয় না। যদি অবাক এর দ্বারা দেওয়া একটি পণ্য বর্ণনা অনুযায়ী না হয়, তাহলে আপনার একমাত্র প্রতিকার হল অব্যবহৃত অবস্থায় ফেরত দেওয়া।

10.1 Obak attempts to be as accurate as possible. Obak does not manufacture or produce any product by themselves. Therefore, Obak does not warrant that product descriptions or other content of any product is accurate, complete, reliable, current, or error-free. If a product offered by Obak itself is not as described, your sole remedy is to return it in unused condition.

১১.১ অন্যথায় উল্লেখ করা ব্যতীত, অবাক এ পণ্যের জন্য প্রদর্শিত তালিকা মূল্য বা প্রস্তাবিত মূল্য পণ্যের উপরেই তালিকাভুক্ত সম্পূর্ণ খুচরা মূল্যের প্রতিনিধিত্ব করে, প্রস্তুতকারক বা সরবরাহকারীর দ্বারা প্রস্তাবিত, বা আদর্শ শিল্প অনুশীলন অনুসারে অনুমান করা হয়; অথবা অন্য কোথাও দেওয়া তুলনামূলকভাবে বৈশিষ্ট্যযুক্ত আইটেমের জন্য আনুমানিক খুচরা মূল্য। তালিকা মূল্য বা প্রস্তাবিত মূল্য একটি তুলনামূলক মূল্য অনুমান এবং যে কোনো নির্দিষ্ট দিনে প্রতিটি এলাকায় বিদ্যমান মূল্য প্রতিনিধিত্ব করতে পারে বা নাও হতে পারে।

11.1Except where noted otherwise, the list price or suggested price displayed for products on Obak represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The list price or suggested price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day.

11.2 Despite our best efforts, a small number of the items in our catalog may be mispriced. If the MRP of an item sold by Obak is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. And if the stated price on the product is lower than Obak, we will, either refund the amount or replace the product according to your preference, when acknowledged.

১২.১ একজন ব্যবহারকারী ডেলিভারির সময়, বা সাত (৭) দিনের মধ্যে যেকোনো পণ্য ফেরত দিতে পারেন যদি:

ক) পণ্য ব্যবহারকারীর প্রত্যাশা পূরণ করে না,

খ) ডেলিভারির সময় ক্ষতিগ্রস্ত পাওয়া গেছে,

গ) পণ্যের গুণমান এবং পরিমাণ সম্পর্কে সন্দেহ আছে,

ঘ) অস্বাস্থ্যকর/অপ্রত্যাশিত অবস্থায় প্রাপ্ত,

ঙ) প্যাকেজিং সঙ্গে সন্তুষ্ট না,

চ) পণ্য অব্যবহারযোগ্য খুঁজে পেলে,

পচনশীল পণ্য যেমন দুধ, ফল এবং তাজা শাকসবজির জন্য, আমাদের একটি এক (১) দিনের রিটার্ন নীতি আছে ।

আমরা ক্রমাগত রিটার্ন এবং রিফান্ডের অত্যধিক অনুরোধ সহ গ্রাহকদের অ্যাকাউন্ট পর্যবেক্ষণ করছি। এটি প্রতিরোধে আমরা প্রয়োজনীয় পদক্ষেপ নিচ্ছি ।

12.1 A user may return any product during the time of delivery, or within 7 days if:

a) Product does not meet the user’s expectations.

b) Found damaged during delivery

c) Have doubt about the product quality and quantity

d) Received in an unhealthy/ unexpected condition

e) Is not satisfied with the packaging

f) Finds product unusable

For perishable products such as milk, fruits, and fresh vegetables, we have a one (1) day return policy.

We are continuously monitoring accounts of customers with excessive requests of returns and refunds. We take necessary steps to prevent this.

টেস্টিং কিট খোলা বা না খোলা,

খ) পণ্যের অপব্যবহারের কারণে ক্ষতি,

গ) অকার্যকর পণ্যের কারণে আকস্মিক ক্ষতি,

ঘ) ব্যবহার করা/ইনস্টল করা হয়েছে এমন যেকোন ভোগ্য আইটেম,

ঙ) টেম্পারড বা অনুপস্থিত সিরিয়াল/ইউপিসি নম্বর সহ পণ্য,

চ) কোনো ক্ষতি/ত্রুটি যা প্রস্তুতকারকের ওয়ারেন্টির আওতায় নেই,

ছ) যে কোনও পণ্য যা সমস্ত আসল প্যাকেজিং এবং আনুষাঙ্গিকগুলি ছাড়াই ফেরত দেওয়া হয়, যার মধ্যে বাক্স, প্রস্তুতকারকের প্যাকেজিং যদি থাকে, এবং অন্য সমস্ত আইটেম যা মূলত সরবরাহ করা পণ্যের সাথে অন্তর্ভুক্ত ।

12.2 A user may return any unopened or defective up to 10% and less, item within seven(7) days of receiving the item. But following products may not be eligible for return or replacement:

a) Face Mask, Disposable Vinyl Gloves, Alcohol Pads, and Covid Testing Kits opened or unopened,

b) Damages due to misuse of the product ,

c) Incidental damage due to malfunctioning product,

d) Any consumable item which has been used/installed ,

e) Products with tampered or missing serial/UPC numbers ,

f) Any damage/defect which is not covered under the manufacturer’s warranty ,

g) Any product that is returned without all original packaging and accessories, including the box, manufacturer’s packaging if any, and all other items originally included with the product/s delivered.

We only replace items if they are defective or damaged. If you need to exchange it for the same item,contact us and send your item to our warehouse.

১৩.১ অবাক ব্যবহারকারীদের পরিবেশন করার জন্য যথাসাধ্য চেষ্টা করে। কিন্তু যদি কোন পরিস্থিতিতে, আমরা আমাদের প্রতিশ্রুতি পূরণ করতে বা পরিষেবা প্রদান করতে ব্যর্থ হই, আমরা আপনাকে ফোন/টেক্সট/ইমেইল এর মাধ্যমে চব্বিশ(২৪) ঘন্টার মধ্যে অবহিত করব। যদি পরিষেবাটি, যেটি অবাক সম্পূর্ণ করতে ব্যর্থ হয়, কোন অর্থ ফেরতের প্রয়োজন হয়, তবে আমাদের স্বীকৃতির পর সর্বোচ্চ সাত(৭) দিনের মধ্যে অর্থ ফেরত করা হবে।

13.1 Obak tries its best to serve the users. But if under any circumstances, we fail to fulfill our commitment or to provide the service, we will notify you within twenty four(24) hours via Phone/ Text/ Email. If the service, that Obak fails to complete, requires any refund, it will be done maximum within seven(7) Days after our acknowledgement.

১৩.২ উল্লিখিত পরিস্থিতিতে রিফান্ডের অনুরোধগুলি প্রক্রিয়া করা হবে:

ক) অবাক কোন পণ্য পরিবেশন করতে অক্ষম।

খ) পেইড অর্ডার থেকে গ্রাহক যেকোনো পণ্য ফেরত দেন।

গ) পেইড অর্ডার পাঠানোর আগেই গ্রাহক বাতিল করে দেয়।

13.2 Refund requests will be processed under mentioned situation:

a) Unable to serve with any product.

b) Customer returns any product from a paid order.

c) Customer cancels a paid order before it has been dispatched.

উপরের তিনটি পরিস্থিতির জন্য,গ্রাহকের অনুরোধে, অবাক সাত(৭) দিনের মধ্যে ব্যবহারকারীর মূল অর্থপ্রদানের উত্সে অর্থ ফেরতের পরিমাণ স্থানান্তর করবে( তবে পণ্য ডেলিভারি চার্জ অফেরতযোগ্য)। এই অর্থ ফেরত শুধুমাত্র সেই গ্রাহকদের জন্য অনুমোদিত যারা বিকাশ বা কার্ড বা অন্যান্য ইলেকট্রনিক পদ্ধতির মাধ্যমে অর্থ প্রদান করেছেন। নগদ অর্থ প্রদান করা অর্ডারগুলির জন্য, অর্থ ফেরত শুধুমাত্র অবাক ক্রেডিটগুলির মাধ্যমে প্রদান করা হয়।

For all the above three scenarios, Upon customer’s request, Obak will transfer the refund amount to the user’s original payment source within seven(7) days (provided that products delivery charges are non-refundable). Refund is only allowed for customers who have paid via bKash or card or other electronic method. For the orders that are paid via Cash, refund is only to be given through Obak Credits.

14.1 Obak, itself does not produce or manufacture any product, therefore Obak tries to control the quality, but does not give quality assurance for any. We believe the manufacturer/ vendor/ supplier are fully capable of assuring the quality of every product.

১৪.২ যদি কোনো ব্যবহারকারী, অর্ডার ডেলিভারি প্রাপ্তির সময়, স্বাস্থ্য/জীবন/নিরাপত্তার জন্য ক্ষতিকর কোনো পণ্য খুঁজে পান, আমরা সম্পূর্ণ দায় নেব এবং সেই পণ্যের ফেরত গ্রহণ করব। প্রদত্ত ডেলিভারির বারো(১২) ঘন্টা পরে ব্যবহারকারী যদি কোনও হুমকির সম্মুখীন হন, তাহলে আমরা এটিকে নির্মাতা বা সরবরাহকারীদের কাছ থেকে গুণমানের নিশ্চয়তার অভাব হিসাবে বিবেচনা করব।

14.2 If any user, at the time of receiving the order delivery, finds any product injurious to health/ life/ security, we will take full liability and will accept return of that product. If the user faces any threat after twelve(12) hours of the provided delivery, we will consider it as a lacking within the quality assurance from the manufacturers or suppliers.

14.3 All products displayed on the website are subject to change and are subject to availability.

১৪.৪ ওয়েবসাইটের মাধ্যমে প্রদত্ত পরিষেবাগুলি শুধুমাত্র তখনই পাওয়া যায় যখন যে ব্যবহারকারীর কাছে পণ্য (গুলি) বিতরণ করা হবে তার ঠিকানাটি বাংলাদেশের মধ্যে থাকে, অবাক সর্বনিম্ন এক(১) ঘন্টা এবং সর্বোচ্চ পাঁচ (৫) দিনের ডেলিভারি পরিষেবা দিচ্ছে । উপরোক্ত সাপেক্ষে, যদি ব্যবহারকারী একটি সুবিধাজনক সময় উল্লেখ করে এবং অবাক সেই সময়ের মধ্যে পণ্য পাঠাবে। পণ্য সরবরাহের সময় গ্রীষ্মকালে (০৭:০০-১৮:০০) ঘন্টা পর্যন্ত এবং শীতকালে (০৮:০০-১৭:০০) ঘন্টা পর্যন্ত।

14.4 The usage of the Services offered through the Website is only available if the address of the User to which the product (s) is/are to be delivered is within Bangladesh, Obak is serving with minimum one (1)Hour and maximum five(7)days Delivery Service.Subject to the above, if the User specifies a convenient time and Obak will send the products during that time. Product delivery time is in summer up to(07:00-18:00)hours and in winter up to (08:00-17:00)hours.

15. Modifications

১৫.১ Obak এই নিয়ম ও শর্ত গুলো সংশোধন করার অধিকার সংরক্ষণ করে। obak.com.bd এ পোস্ট করার সাথে সাথে এই ধরনের পরিবর্তন কার্যকর হবে। আপনি এই ধরনের পরিবর্তন পর্যালোচনার জন্য দায়ী। obak.com.bd-এ আপনার অব্যাহত অ্যাক্সেস বা ব্যবহারকে পরিবর্তিত নিয়ম ও শর্ত গুলোর সাথে আপনার সম্মতি আছে বলে গণ্য করা হবে।

15.1 Obak reserves the right to modify these Terms and Conditions. Such modifications shall be effective immediately upon posting on obak.com.bd. You are responsible for the reviewing of such modifications. Your continued access or use of obak.com.bd shall be deemed your acceptance of the modified terms and conditions.

১৬.১ Obak সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ এর ব্যবহার:

আপনি Obak সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহার করতে পারেন শুধুমাত্র অবাক দ্বারা প্রদত্ত পরিষেবাগুলি ব্যবহার করতে এবং উপভোগ করতে সক্ষম করার উদ্দেশ্যে, এবং এই শর্তাবলী দ্বারা অনুমোদিত ৷ আপনি অবাক সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপের কোনো অংশ আপনার নিজস্ব প্রোগ্রামে অন্তর্ভুক্ত করতে পারবেন না বা আপনার নিজের প্রোগ্রামের সাথে এটির কোনো অংশ সংকলন করতে পারবেন না, অন্য পরিষেবার সাথে ব্যবহারের জন্য এটি স্থানান্তর করতে পারবেন না, বা বিক্রি, ভাড়া, লিজ, ধার, ঋণ, Obak সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ বিতরণ বা উপ-লাইসেন্স বা অন্যথায় Obak সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপকে সম্পূর্ণ বা আংশিকভাবে কোনো অধিকার বরাদ্দ করুন। আপনি কোন অবৈধ উদ্দেশ্যে Obak সফটওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহার করতে পারবেন না। আমরা যেকোনও অবাক সফটওয়্যার/অ্যাপ্লিকেশন/অ্যাপ প্রদান বন্ধ করে দিতে পারি এবং আমরা যেকোনও সময় যেকোন অবাক সফটওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহার করার আপনার অধিকার বাতিল করতে পারি। অবাক সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহার করার জন্য আপনার অধিকার স্বয়ংক্রিয়ভাবে আমাদের কাছ থেকে কোনো নোটিশ ছাড়াই শেষ হয়ে যাবে যদি আপনি এই শর্তাবলীর যেকোনো একটি মেনে চলতে ব্যর্থ হন। অবাক পরিষেবায় ব্যবহৃত সমস্ত সফ্টওয়্যার অবাক এবং/অথবা এর সহযোগী বা এর সফ্টওয়্যার সরবরাহকারীদের সম্পত্তি এবং বাংলাদেশের আইন দ্বারা সুরক্ষিত কিন্তু অন্য কোনও প্রযোজ্য কপিরাইট আইনের মধ্যে সীমাবদ্ধ নয়।

16.1 Use of the Obak Software/Application/App : You may use Obak Software/ Application/ App solely for purposes of enabling you to use and enjoy the services as provided by Obak, and as permitted by these Terms. You may not incorporate any portion of the Obak Software / Application/ App into your own programs or compile any portion of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the Obak Software / Application/ App or otherwise assign any rights to the Obak Software / Application/ App in whole or in part. You may not use the Obak Software / Application/ App for any illegal purpose. We may cease providing any Obak Software / Application/ App and we may terminate your right to use any Obak Software / Application/ App at any time. Your rights to use the Obak Software / Application/ App will automatically terminate without notice from us if you fail to comply with any of these Terms. All software used in any Obak Service is the property of Obak and/or its affiliates or its software suppliers and protected by laws of Bangladesh including but not limited to any other applicable copyright laws.

১৬.২ তৃতীয় পক্ষের পরিষেবাগুলির ব্যবহার:

আপনি যখন অবাক সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ ব্যবহার করেন, তখন আপনি হয়ত এক বা একাধিক তৃতীয় পক্ষের পরিষেবাও ব্যবহার করছেন, যেমন একটি ওয়্যারলেস ক্যারিয়ার বা একটি মোবাইল প্ল্যাটফর্ম প্রদানকারী ৷ এই তৃতীয় পক্ষের পরিষেবাগুলির আপনার ব্যবহার সেই তৃতীয় পক্ষের পৃথক নীতি, ব্যবহারের শর্তাবলী এবং ফী গুলির সাপেক্ষে হতে পারে ৷

16.2 Use of Third Party Services: When you use the Obak Software / Application/ App, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile platform provider. Your use of these third party services may be subject to the separate policies, terms of use, and fees of those third parties.

১৬.৩ রিভার্স ইঞ্জিনিয়ারিং না :

আপনি অবাক সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপকে সম্পূর্ণ বা সম্পূর্ণভাবে অনুলিপি, পরিবর্তন, রিভার্স ইঞ্জিনিয়ারিং, ডিকম্পাইল বা ডিসসেম্বল করতে বা অন্যথায় কারসাজি করতে অন্য কোনো ব্যক্তিকে উৎসাহিত, সহায়তা বা অনুমোদন করবেন না, বা Obak সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ বা এর কোনো তৈরি করা ডেরিভেটিভ কাজ থেকে ।

16.3 No Reverse Engineering:

You may not, and you will not encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, the Obak Software / Application/ App, whether in whole or in part, or create any derivative works from or of the Obak Software / Application/ App.

১৬.৪ আপডেট:

Obak সফ্টওয়্যার/অ্যাপ্লিকেশন/অ্যাপ আপ-টু-ডেট রাখার জন্য, আমরা যেকোন সময় এবং আপনাকে নোটিশ ছাড়াই স্বয়ংক্রিয় বা ম্যানুয়াল আপডেট দিতে পারি।

16.4 Updates:

In order to keep the Obak Software / Application/ App up-to-date, we may offer automatic or manual updates at any time and without notice to you.

17. Deleting your Obak Account

১৭.১ গ্রাহকরা সর্বদা তাদের ব্যবহৃত ডিভাইস থেকে Obak ওয়েবসাইট বা অ্যাপ থেকে অ্যাকাউন্ট মুছে দিয়ে ওবাকের ব্যবহার বন্ধ করতে পারে ।

17.1 Customers may terminate their use of Obak by deleting the account from the Obak website or App from their used device at all times.

১৭.২ আপনার অবাক অ্যাকাউন্টটি কেবল তখনই মুছে ফেলা হতে পারে যদি নিম্নলিখিত শর্তগুলির মধ্যে যেকোনটি পূরণ করা হয় এবং যদি আপনি অবাক এর সাথে এই বিষয়ে একমত হয়ে থাকেন :

ক) কোন ওভারডু পেমেন্ট, পেন্ডিং পেমেন্ট, বা বাকি ব্যালেন্স নেই ,

খ) কোন চলমান আদেশ নেই ।

17.2 Your Obak account may only be deleted if any of the following conditions are fulfilled and if you have reached a consensus with Obak in respect of:

a) No overdue payments, pending payments, or remaining balance,

b) No ongoing orders.

১৭.৩ গ্রাহকের দ্বারা নির্ধারিত কোন শর্তাবলীর বা প্রযোজ্য আইন বা সদয় বিশ্বাস/নৈতিক নিয়ম লঙ্ঘনের ক্ষেত্রে অবাক গ্রাহকের সদস্যপদ স্থগিত করার বা গ্রাহককে স্থায়ীভাবে অপসারণ করার অধিকার সংরক্ষণ করে ।

17.3 Obak reserves the right to suspend Customer’s membership or remove Customer permanently in cases where any violation of the Terms, applicable laws or good faith/moral rules by Customer is determined.

১৭.৪ অবাক শিল্পের মান, প্রাসঙ্গিক আইন এবং প্রবিধান অনুযায়ী অ্যাকাউন্ট বন্ধ করার জন্য ত্রিশ(৩০) দিনের ধরে রাখার সময়সীমা নির্ধারণ করেছে। অবাক এই ধরে রাখার সময়কালে গ্রাহকদের ডেটা রাখার অধিকার সংরক্ষণ করে। ধরে রাখার সময়কালের পরে, গ্রাহকরা তাদের পুরানো অ্যাকাউন্টগুলি পুনরায় সক্রিয় করতে বা তাদের পুরানো ডেটা পুনরুদ্ধার করতে পারবেন না।

17.4 Obak has set up a thirty(30) days retention period for account closure in accordance with industry standards, relevant laws, and regulations. Obak reserves the right to hold customers’ data during this retention period. After the retention period, customers will not be able to reactivate their old accounts or retrieve their old data.

১৭.৫ যখন অ্যাকাউন্ট মুছে ফেলার প্রক্রিয়া সম্পন্ন হয় (অর্থাৎ ধরে রাখার সময়কাল শেষ হয়) তখন গ্রাহক এবং অবাক এর মধ্যে সমস্ত চুক্তিগত সম্পর্ক শেষ হয়ে যাবে। অ্যাকাউন্ট মুছে ফেলার পরিণতিগুলির মধ্যে রয়েছে তবে নিম্নলিখিতগুলির মধ্যে সীমাবদ্ধ নয়:

ক) গ্রাহক অবাক ওয়েবসাইট বা অ্যাপে লগ ইন করতে এই অ্যাকাউন্টটি ব্যবহার করতে পারবেন না।

খ) গ্রাহক এমন কোনো ক্রিয়াকলাপ সম্পাদন করতে পারবেন না যার জন্য অ্যাকাউন্ট অ্যাক্সেস প্রয়োজন।

গ) গ্রাহক অ্যাকাউন্টের অধীনে ব্যক্তিগত তথ্য, লেনদেনের রেকর্ড এবং ঐতিহাসিক তথ্য পুনরুদ্ধার করতে সক্ষম হবেন না।

17.5 When the account deletion procedure is completed (i.e.the retention period ends) all related contractual relationships between the Customer and Obak will be terminated. The consequences of account deletion include but are not limited to the following:

a) The Customer will not be able to use this account to log in to the Obak website or app.

b) The Customer will not be able to perform any operations that require account access.

c) The Customer will not be able to retrieve the personal information, transaction records and historical information under the account.

১৭.৬ Obak আপনার ডেটা মুছে ফেলবে এবং অবিলম্বে আপনার ব্যক্তিগত তথ্য এবং অন্যান্য ডেটা সংগ্রহ করা, সংরক্ষণ করা এবং ব্যবহার করা বন্ধ করবে, প্রযোজ্য আইন এবং প্রবিধান বা শিল্প মান দ্বারা অন্যথায় প্রয়োজন ছাড়া। উদাহরণ স্বরূপ, অবাক ট্যাক্স কমপ্লায়েন্সের উদ্দেশ্যে সংশ্লিষ্ট ইনভয়েস ডেটা ধরে রাখবে এবং প্রাসঙ্গিক ই-কমার্স আইন মেনে চলার জন্য আপনার এবং অবাকের মধ্যে লেনদেনের তথ্য রাখবে।

17.6 Obak will delete your data and immediately stop collecting, storing, and using your personal information and other data, except as otherwise required by applicable laws and regulations or industry standards. For example, Obak will retain corresponding invoice data for tax compliance purposes, and keep the transaction information between you and Obak to comply with relevant e-commerce laws.

20. Handling Fee

২০.১ হ্যান্ডলিং ফী হল এক ধরণের পরিষেবা চার্জ, অর্থাৎ যে পণ্যগুলির জন্য অতিরিক্ত পরিমাণে চার্জ করা হয় সেগুলির জন্য অবাক থেকে উত্স, সঞ্চয় এবং বিতরণের জন্য অতিরিক্ত প্রচেষ্টার প্রয়োজন হয় ৷

20.1 Handling Fee is a kind of service charge, i.e. an extra amount charged for the products that require additional efforts from Obak to source, store and deliver.

২০.২ হ্যান্ডলিং ফী ডেলিভারি চার্জ এর একটি ধরন ।

20.2 Handling Fee is exclusive of delivery charge.

২০.৩ যে পণ্যগুলির বিভিন্ন কারণে ক্ষতিগ্রস্থ হওয়ার সম্ভাবনা রয়েছে এবং/অথবা ডেলিভারির জন্য অতিরিক্ত প্রচেষ্টার প্রয়োজন, তাদের সাথে একটি হ্যান্ডলিং ফী যোগ করা হবে।

20.3 Products that have the possibility of getting damaged for various reasons and/ or require extra effort to deliver, will have a handling fee added to them.

২০.৪ ফেরত বা ফেরত দেওয়ার ক্ষেত্রে যে পণ্যটির হ্যান্ডলিং ফী রয়েছে তার জন্য আমরা হ্যান্ডলিং ফী বাদ দিয়ে পুরো পরিমাণ ফেরত দেব ।

20.4 For the product that has a handling fee in case of return or refund we will be refunding the whole amount without the handling fee.
